Rusia konsiderohet një nga fuqitë kryesore strategjike me kapacitete bërthamore nëndetëse, të cilat përbëjnë një kërcënim të vazhdueshëm për sigurinë globale dhe stabilitetin ndërkombëtar. Nëndetëset bërthamore janë pjesë integrale e triumit strategjik rus, së bashku me raketat bërthamore tokësore dhe ajrore, duke i mundësuar Rusisë aftësi për afirmim strategjik global dhe presion mbi aleatët.
1. Format e kërcënimit
• Kërcënim strategjik: Nëndetëset bërthamore mund të lëshojnë raketa balistike që godasin qytete dhe qendra industriale në çdo kontinent.
• Kërcënim detar dhe ekonomik: Aftësia e Rusisë për të kontrolluar zona strategjike detare dhe për të kryer operacione nënujore pengon lundrimin dhe tregtinë ndërkombëtare.
• Kërcënim politik dhe psikologjik: Nëndetëset bërthamore përdoren si mjet për të ushtruar presion ndaj NATO-s, SHBA dhe vendeve aleate.
2. Rregullimi ndërkombëtar dhe përgjegjësia ligjore
Sipas Konventës së OKB mbi të Drejtën e Detit (UNCLOS, 1982):
1. Nëndetëset bërthamore lejohen të lundrojnë në det të hapur, por duhet të respektojnë detyrimet ndërkombëtare për mos-përdorimin e forcës dhe mbrojtjen e sigurisë detare.¹
2. Çdo përdorim i nëndetëseve për shkelje të sovranitetit ose kërcënime ndaj anijeve civile përbën shkelje të qartë të rendit juridik ndërkombëtar.²
3. Kapacitetet bërthamore nënujore duhet të administrohen në përputhje me traktatet ndërkombëtare për kontroll dhe transparencë, përfshirë START I/II dhe New START.³
4. UNCLOS kërkon që shtetet të ushtrojnë kontroll efektiv mbi anijet dhe nëndetëset e tyre, për të parandaluar abuzimet që mund të rrezikojnë sigurinë ndërkombëtare.⁴
3. Recidivizmi rus dhe shkeljet konkrete
Rusia ka treguar një model recidiv i kërcënimit nënujor, duke kryer veprime që shpesh cenojnë rendin ndërkombëtar:
• Barents Sea dhe Arctic Ocean: Patrullime strategjike të nëndetëseve bërthamore pranë ujërave të NATO-s dhe vendeve aleate, shpesh pa paralajmërim dhe në mënyrë të fshehtë.⁵
• Atlantiku dhe Paqësori: Operacione të fshehta nënujore, përfshirë manovra dhe testime raketash, që rrisin tensionin dhe pengojnë lundrimin e lirë.⁶
• Shkelja e parimeve të sigurisë ndërkombëtare: Përdorimi i nëndetëseve për operacione strategjike që kërcënojnë anijet civile dhe instalimet detare konsiderohet veprim destabilizues dhe provokativ.⁷
3.1. Raste specifike të raportuara
• K-535 Yury Dolgoruky (Rusi, 2013-2020): Patrullime në Atlantik dhe Paqësor, operacione strategjike të fshehta që rrisin tensionin global.⁸
• Testimet e raketave SLBM Bulava nga nëndetëset bërthamore në Barents Sea: Provokim i drejtpërdrejtë ndaj sigurisë ndërkombëtare dhe shkelje e frymës së traktateve për reduktim të rrezikut bërthamor.⁹
4. Rusia dhe shkeljet në det të hapur – rastet “Bella 1 / Marinero”
Në këtë kontekst, Rusia ka kryer veprime konkrete që cenojnë rendin juridik ndërkombëtar:
• Anija Bella 1, më pas Marinero, ngriti flamurin rus pa regjistrim të vlefshëm, duke e kualifikuar si anije pa flamur. Kjo shkel UNCLOS nenet 91-92, të cilat kërkojnë një lidhje reale të anijes me shtetin flamur.¹⁰
• Kapja e anijes nga SHBA ishte ligjore, në përputhje me nenin 110(1)(c) të UNCLOS dhe jurisprudencën e ITLOS (M/V Saiga, Grand Prince, Arctic Sunrise).¹¹
• Ky rast tregon modelin e Rusisë për të abuzuar me parimet e rendit juridik detar, duke përdorur anijet dhe nëndetëset për qëllime që cenojnë sigurinë ndërkombëtare.
5. Efektet globale dhe precedentët
Veprimet e Rusisë:
• Krijojnë precedent për abuzime të mëtejshme me fuqinë strategjike dhe kapacitetet bërthamore, duke destabilizuar rendin global.
• Cenojnë parimin e sigurisë dhe stabilitetit detar, duke minuar mekanizmat ndërkombëtarë të kontrollit.
• Jurisprudenca ndërkombëtare konfirmon se abuzimi me fuqinë bërthamore ose flamurin e anijeve cenon rendin juridik ndërkombëtar.¹²

Konkluzioni: Kapacitetet strategjike bërthamore dhe veprimet e Rusisë në det të hapur përbëjnë shkelje të UNCLOS, shkelje të traktateve bërthamore dhe një kërcënim të vazhdueshëm për sigurinë ndërkombëtare. SHBA dhe aleatët kanë të drejtë ligjore dhe strategjike të përgjigjen për të mbrojtur rendin ndërkombëtar.

Russia is considered one of the major strategic powers with nuclear submarine capabilities, which constitute a continuous threat to global security and international stability. Nuclear submarines are an integral part of Russia’s strategic triad, alongside land-based and air-launched nuclear missiles, enabling Russia to exert global strategic influence and pressure allied states.
1. Forms of the Threat
• Strategic Threat: Nuclear submarines can launch ballistic missiles targeting cities and industrial centers across continents.
• Maritime and Economic Threat: Russia’s ability to control strategic maritime areas and conduct underwater operations hinders free navigation and international trade.
• Political and Psychological Threat: Nuclear submarines are used as a tool to exert pressure on NATO, the U.S., and allied states.
2. International Regulation and Legal Responsibility
Under the United Nations Convention on the Law of the Sea (UNCLOS, 1982):
1. Nuclear submarines are allowed to operate in international waters, but must respect international obligations regarding non-use of force and maritime security.¹
2. Any use of submarines to violate sovereignty or threaten civilian vessels constitutes a clear breach of international law.²
3. Nuclear underwater capabilities must be managed in accordance with international arms control and transparency treaties, including START I/II and New START.³
4. UNCLOS requires states to exercise effective control over their ships and submarines to prevent abuses that endanger international security.⁴
3. Russia’s Recidivist Violations
Russia has shown a pattern of recidivism in underwater threats, engaging in activities that frequently breach international law:
• Barents Sea and Arctic Ocean: Strategic patrols of nuclear submarines near NATO and allied waters, often unannounced and covert.⁵
• Atlantic and Pacific Oceans: Secret underwater operations, including missile tests and maneuvers, increasing tension and hindering free navigation.⁶
• Violation of International Security Principles: Using submarines for strategic operations that threaten civilian ships and maritime installations is considered destabilizing and provocative.⁷
3.1. Specific Reported Cases
• K-535 Yury Dolgoruky (Russia, 2013-2020): Patrols in the Atlantic and Pacific, conducting covert strategic operations that heighten global tension.⁸
• Bulava SLBM missile tests from nuclear submarines in the Barents Sea: Direct provocation against international security and violation of nuclear arms reduction treaties.⁹
4. Russia and Open Sea Violations – the “Bella 1 / Marinero” Case
In this context, Russia has engaged in concrete actions undermining the international legal order:
• The ship Bella 1, later Marinero, hoisted the Russian flag without valid registration, classifying it as a stateless vessel. This violates UNCLOS Articles 91-92, which require a genuine link between a vessel and its flag state.¹⁰
• The U.S. capture of the vessel was lawful, in accordance with UNCLOS Article 110(1)(c) and ITLOS jurisprudence (M/V Saiga, Grand Prince, Arctic Sunrise).¹¹
• This case illustrates Russia’s pattern of abusing international maritime legal principles, using ships and submarines for actions that threaten international security.
5. Global Effects and Precedents
Russia’s actions:
• Create a precedent for further abuse of strategic power and nuclear capabilities, destabilizing the global order.
• Undermine maritime safety and security, weakening international oversight mechanisms.
• International jurisprudence confirms that abuse of nuclear power or vessel flag status undermines the international legal order.¹²
